CuddleCharts is a baby tracking application that allows parents and caregivers to log feeding, sleep, diaper changes, medicine, growth measurements, and postpartum wellness data. The App also provides AI-powered insights, pediatrician visit preparation, and caregiver sharing features.

2. Account Registration

To use CuddleCharts, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality or servers
• Upload or transmit any malicious code, viruses, or harmful content
• Use the App to collect or harvest personal information of other users
• Impersonate any person or entity, or falsely state your affiliation

4. Medical Disclaimer

IMPORTANT: CuddleCharts is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

• The App is designed to help you track and organize caregiving activities. It is not a substitute for professional medical advice, diagnosis, or treatment.
• AI-powered insights are generated using artificial intelligence and are intended for informational purposes only. They should not be relied upon as medical advice.
• Growth tracking features, including any percentile calculations, are for informational purposes only and should not replace professional pediatric assessments.
• Postpartum wellness tracking is for personal awareness only. If you experience concerning symptoms, please contact your healthcare provider immediately.
• Always seek the advice of your pediatrician or other qualified healthcare provider with any questions regarding your child's health or your own health.

5. AI-Powered Features

CuddleCharts uses artificial intelligence to provide insights and recommendations. You acknowledge that:

• AI-generated insights are based on the data you provide and may not be accurate or complete
• AI recommendations are not medical advice and should not be treated as such
• We are not responsible for any decisions made based on AI-generated content
• AI features may be updated, modified, or discontinued at any time

6. Caregiver Sharing

When you invite caregivers to access your baby's profile:

• You are responsible for managing who has access to your data
• Invited caregivers can view and log data for the shared baby profile
• You can revoke caregiver access at any time
• We are not responsible for how invited caregivers use the information they access

7. Subscriptions and Payments

CuddleCharts may offer free and paid tiers:

• Free features may be limited in scope and functionality
• Paid subscriptions are managed through Apple's App Store and are subject to Apple's payment terms
• Subscription prices may change with reasonable notice
• You can cancel your subscription at any time through your App Store settings
• Refunds are handled by Apple according to their refund policy

8. Intellectual Property

The App, including its design, features, content, and underlying code, is owned by CuddleCharts and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App.

9. Your Content

You retain ownership of the data you enter into the App. By using CuddleCharts, you grant us a limited license to process, store, and display your data solely for the purpose of providing and improving our services.

10. Limitation of Liability

To the maximum extent permitted by law, CuddleCharts and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you have paid for the App in the 12 months preceding the claim. The App is provided “as is” without warranties of any kind, either express or implied.

11. Account Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activities
• We are required to do so by law

You may delete your account at any time through the App's settings. Upon deletion, all your data will be permanently removed within 30 days.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
